How it works

Formula

Covered employers: last salary × 15/26 × years, with part-years over six months rounded up. Others: average salary × 15/30 × completed years.

Cap

₹20 lakh is the most the Act requires an employer to pay, and the most that is exempt from tax across your working life.

Tax

Government employees: fully exempt. Everyone else: the least of what you received, ₹20 lakh and the formula amount. The rest is salary income.

Check the gratuity figure before you sign the full-and-final

Gratuity errors usually come from three places: counting the wrong salary (HRA included, DA excluded), rounding the service period the wrong way, or applying the Act formula to an employer that is not covered. Enter basic plus DA and your exact service, pick the employer type, and the calculator shows the formula amount, whether the ₹20 lakh cap bites, and how much of what you receive is taxable. Useful on both sides of the table: employees checking a settlement, and HR or CA teams preparing one.

Six-month rounding

7 years 7 months counts as 8 under the Act. 7 years 5 months counts as 7. Outside the Act, only completed years count.

26 vs 30 days

The Act divides by 26 working days; the non-covered formula divides by 30. On the same salary the Act pays about 15% more per year.

Five-year rule

Required for resignation and retirement, waived on death or disablement. The calculator applies the waiver when you select it.

Exemption, not deduction

Section 10(10) is available under both tax regimes and is not affected by choosing the new regime.
